[India_Vision_2020] Documentations of dark days of Indian emergency - lost and regained

dear friends

We have been writing often in our group, about the various past happenings in the Indian history and also about great forgotten Indian leaders. Attempts are being made by  various vested interests, to distort and to remove important happenings in our Indian history, so that the younger generations do not get the past history properly.

One such attempt was to remove  the documents relating to excesses and abuse of democracy during 21 month old emergency in 1975-77.  In June 1975, state of emergency was declared in India by the then Indian Prime Minister Indira Gandhi, after her election to Lok Sabha was nullified by Allahabad High Court.  Many opposition leaders like Lok Nayak Jayaprakash Narayan, Morarji Desai, Vajpayee, Advani, Ashok Mehta, George Fernandes were arrested under MISA and were imprisoned.

In the 1977 General elections held after the emergency was lifted, Congress got washed out completely in the North India, while South returned Congress.  Even Indira Gandhi and Sanjay Gandhi lost their elections.  Lok Nayak Jayaprakash Narayan (popularly known as JP) was the mentor for the newly formed Janata Party.  Janata Party formed the Government under Morarji Desai.  This struggle was considered as 'second freedom struggle' to save democracy.

Morarji Desai Government constituted a commission in April 1977 under the chairmanship of former Chief Justice of India Justice J C Shah to look into the abuses and excesses of emergency.  Shah Commission submitted its report in August 1978 in the Parliament.  The report was a startling one and revealed the emergency excesses.  Since press censorship was enforced during emergency, none of the media reported any excess, during that time.  Hence, Shah Commission report is the only available document, about the emergency.

Due to internal problems among the leaders, Janata Government fell.  In the general elections held in 1980, Indira Gandhi returned to power.  After coming to power, all the copies of Shah Commission report were destroyed from all the libraries.  Even Parliament library does not have any reference copy even now.  According to reports, only two copies are available in National library of Australia and London University library.

Even after three decades, no attempts were made by any authority to get back the lost Shah Commission report.  At this stage, Mr Erz Sezhiyan, a well known Parliamentarian and one of the founders of Janata Party along with JP, Vajpayee and others, picked up the copy of the Shah Commission Report from his personal library and has now published the book last week  under the title, 'Shah Commission Reprot - Lost and regained".

Mr Era Sezhiyan, now 87, is a passionate parliamentarian and has served nearly both the houses for nearly 25 years. He is considered as one of the authorities in Indian parliamentary procedures and practices.   He is maintaining a library at his house with more than 6000 rare documents/books.  He is preserving  all the important parliamentary reports, proceedings almost since 1965.  Constitutions of all the countries in the world are available with him.  I  think, even national political parties may not have such huge rare collections.

I interviewed Mr Erz Sezhiyan in his library about the burred Shah Commission report.  I am sharing this interview and other details for the benefit of new generation, to get the history right.

Please watch his interview in the following link:

When we formed Education Loan Task Force last year (ELTF) as part of India Vision Group, we had great challenges and many banks were not following the guidelines properly.  There were many complaints.  Our media friends also carried articles in their media about the education loan guidelines to create awareness.

Many Public Sector Banks have been giving us lot of support and cooperation. Whenever, we brought to the notice of senior officials about the aberrations, many banks (excepting some) took up  our complaints seriously and rectified the complaints.

From our past one year experience, we have identified two banks for honouring during the 5th  UnConference of Action 2020  scheduled on 23rd December 2010 at Chennai.  They are State Bank of India, Chennai Circle and Indian Bank Head Office.

Both the banks are the toppers in granting education loan both in India and in Tamilnadu.  Whenever we made complaints to the CGM (State Bank of India) and Chairman of Indian Bank, they promptly responded and followed up with the students and the branches to sort out the problems.  Whenever we reported  that the guidelines were not followed, they took immediately remedial actions.  At our request, both the banks issued circulars to their Regional offices on some of the common problems faced by the students.

Though, ELTF does not expect 100% perfection of the branches in  following the guidelines due to their large network and manpower, we expected the banks to be more responsive whenever we brought the problems to their notice.  We are really happy that both the banks, took pro-active initiatives and handled every complaints in a professional way.

ELTF takes pleasure in complimenting both the banks, particularly Mrs Cauvery (DGM of State Bank of India) and Mr Swaminathan (Chief Manager, Indian Bank Head Office and in charge of Education Loan) for their cooperation. Both these senior officials were coordinating with ELTF on behalf of their respective banks.

As a token of our appreciation, on behalf of India Vision Group and  ELTF. we  will be inviting them to the 5th UnConference of Action 2020 and honour them on 23rd December 2010.

Whenever, we find fault with them, we accuse them.  At the same time, we should also not forget to appreciate  and  honour them, when they respond positively.  This will motive them further to contribute more  for the nation building.  Hope our gesture will motivate other banks also to contribute more and more to the nation.

On behalf of India Vision Group and ELTF, we congratulate State Bank of India and Indian Bnk for their contribution to the nation  through education loan.

This is excellent. Full marks to the banks for taking up our complaints seriously and acting on time. People dont realise that they are dealing with childrens' lives here by acting lazy and bureaucratic. But if in that lot, we see some shine, surely we should praise them and recognise them.

I liked what you said about, when they are wrong, we accuse them at same time , we should appreciate them when they are right! This task force is doing a major service to the society. My heartfelt congratulations to all involved. May the force go on and on...

Re:: [India_Vision_2020] Chennai High Court directs Banks not to reject edu loan on technical grounds

Dear Shri Srinivasan

There is much talk about the High Court judgement.  Most of the readers are quoting from the spirit of the judgement only.  The text of the judgement or the actual case is that:  "No due certificate from the father, even if known that he has taken a loan from another bank for a pure business purpose, should not be insisted for grant of an educational loan for such borrower's son/daughter."  General principles of lending that banker's lien is a general lien and the banker's general norms of lending etc are all not the legal issues in this case.
